Can you legally live and work in the UK without claiming asylum?
The honest answer: you almost never can "switch" from the asylum process to a work visa inside the UK — and this is exactly the myth "agents" make money on. Legal routes exist, but nearly all of them start from home: the Seasonal Worker visa (£340, no language or degree requirements), Skilled Worker (from £41,700 and B2 English — a route for specialists), study. After an asylum refusal a re-entry ban applies — from 12 months to 10 years, and its length depends on how you leave. Below: what is real, what is a myth, and how not to hand your money to scammers.
It does not work like that. Skilled Worker rules directly bar in-country applications from people on immigration bail — the normal status of someone with a pending or refused asylum claim. The Seasonal Worker visa can only be applied for from outside the UK. No "agent" can get around this — they can only take your money. The official gov.uk position: "There are no shortcuts to working in the UK, and a legitimate employer would never ask for payment to secure a visa."
If you are in the asylum process now
The suitability requirements for in-country applications exclude people on immigration bail. Abandoning your asylum claim for the sake of a "visa" means losing protection and getting no visa in return. Make decisions about your case only with a regulated adviser.
If you have been waiting for a decision for more than 12 months and the delay is not your fault, you can ask for permission to work, free of charge. The restrictions are serious: only jobs from the approved list, no self-employment. It is not a "visa" and not a path to Skilled Worker.

If you were refused: re-entry bans and when the road opens again
After a breach of immigration rules (refusal plus staying without status), new visa applications are automatically refused for a set period. The period depends on how you leave:

A softening rule: an overstay of up to 30 days (from 6 April 2017) followed by a voluntary departure does not count as a breach for these bans. Worth knowing: a ban is not forever. Once it ends, you apply for visas in the normal way: seasonal work, Skilled Worker, study. Leaving voluntarily at your own expense is the shortest path to a "clean" record.
Legal routes — if you are at home or planning a move
£340 per application, up to 6 months on farms (harvesting) or a season in poultry. No language or degree requirements. Work only through official scheme operators — and they never charge for a place. The visa cannot be extended and does not lead to settlement — after the season you must leave, but you can come again.
You need: a licensed sponsor employer, a salary of at least £41,700 a year (in some cases from £33,400), a degree-level occupation and B2 English (for new applicants from 8 January 2026). Costs: the visa at £819–£1,618 plus the health surcharge of £1,035 per year. Realistic for IT, engineering, medicine. The care worker route closed to new overseas applicants on 22 July 2025 — "care visa" offers in 2026 are scams.
Student visa: course fees plus proven living funds — £1,529 a month in London / £1,171 outside London (up to 9 months), held for 28 consecutive days. Work — up to 20 hours a week in term time. You cannot bring family (except government-sponsored students and PhD researchers). After graduating — the Graduate visa: currently 2 years, 18 months for applications from 1 January 2027. The fully funded Chevening scholarship covers everything — applications open in August.
Spouse/partner visa: the UK sponsor needs an income of at least £29,000 a year (since 11 April 2024), with a 5-year path to settlement. A "sham marriage for money" is a criminal offence for both sides and a lifelong stain on your immigration record.
Youth Mobility Scheme — no Central Asian countries on the list. High Potential Individual — no universities from the region on the list. A "work visa without an employer", a "freelancer visa", an "investor visa for $10,000" — no such routes exist at all.
How not to hand your money to scammers
- A Certificate of Sponsorship is not for sale. An employer assigns it for a real vacancy. Employers are banned from passing sponsorship costs on to the worker — that costs them their licence.
- Check the sponsor in the official register. The Home Office publishes the list of all licensed sponsors (updated almost daily). Not in the register — no visa, whatever they promise.
- Seasonal scheme operators never charge for a "place". The official operators are in the same register (Seasonal Worker route). If someone asks for money to put you on a list — they are not an operator.
- Advertising fake sponsorship is a criminal offence in the UK (up to 5 years in prison). Screenshots of Telegram "offers" can and should be reported.
- Red flags per gov.uk: a "guaranteed visa", upfront payment in cash or crypto, requests for bank details, demands for secrecy and urgency.

My asylum claim was refused. When can I come back legally?
It depends on how you leave. Leave voluntarily at your own expense — the ban is normally 12 months. Leave voluntarily but at Home Office expense (ticket, payments) — 2 years if you left within 6 months of being notified, 5 years if later. Deportation — 10 years. Once the ban ends, you can apply for visas in the normal way.
What is permission to work after 12 months?

Is a Skilled Worker visa realistic from Uzbekistan or Tajikistan?
Formally yes, in practice — mostly for specialists. You need: a job with a licensed sponsor paying at least £41,700 a year (in some cases £33,400), an occupation at degree level, and English at B2 (for new applicants from 8 January 2026). Plus costs: the visa at £819–£1,618 and the health surcharge at £1,035 per year.
What about the care worker visa?
For new applicants from overseas this route closed on 22 July 2025. Only people whose sponsorship was issued before that date can extend. If someone offers you a "care visa" for money in 2026 — it is a scam. For nurses and doctors the route remains open, but requires recognition of your qualification by UK regulators.
Is there Youth Mobility or a talent visa for Central Asia?
Youth Mobility Scheme — no: Uzbekistan, Tajikistan, Kyrgyzstan and Kazakhstan are not on the list of countries. High Potential Individual — also no: the university list includes no Central Asian universities. Global Talent requires international recognition in science, culture or tech.
Can I bring my family if I come to study?
Since 1 January 2024 — almost nobody can. Only government-sponsored students (on courses longer than 6 months) and postgraduate researchers (PhD and research-based degrees) can bring a partner and children. Ordinary Master’s and Bachelor’s courses give no family rights.
Come as a visitor and find a job — is that an option?
No. You cannot work on a visit — paid or unpaid. Breaching conditions and overstaying damage your immigration history: future visas will be refused. The only softening: an overstay of up to 30 days followed by a voluntary departure does not count as a breach for future bans.
