What to know about modern Uzbekistan

After Karimov's death in 2016, President Shavkat Mirziyoyev announced a series of "reforms". By 2024–2026 human rights defenders characterise the state as consolidated authoritarian: no legal opposition exists, the judiciary remains an appendage of the executive.

📜 Karakalpakstan 2022 — crisis continues
July 2022: suppression of protests in the Republic of Karakalpakstan, at least 21 killed according to official data. Protest leader Dauletmurat Tajimuratov sentenced to 16 years. 22 February 2024 the Supreme Court of Uzbekistan designated "Alga Karakalpakstan" as an extremist organisation — association with it is now criminalised. Human rights defenders from Karakalpakstan abroad face extradition requests through Uzbekistan's ties with Russia and Kazakhstan.
🕌 Religious persecution — Article 244
Articles 244-1 and 244-2 of the Criminal Code of Uzbekistan criminalise production, storage or distribution of "extremist materials". In practice they are used to persecute Muslims suspected of links with Hizb ut-Tahrir, Tablighi Jamaat, Salafi communities. In 2024 at least two groups of up to 23 people were arrested on charges of HT membership. Persecution is often triggered by downloading Islamic nasheeds or sermons on Telegram/YouTube. Christian converts and Jehovah's Witnesses are also persecuted.
🏳️‍🌈 LGBT — male homosexuality criminalised
Article 120 of the Criminal Code of Uzbekistan provides criminal liability for consensual same-sex relations between men. Draft "anti-LGBT propaganda" laws are being prepared. The Home Office in CPIN SOGIE July 2024 explicitly recognised that the state "is not willing to provide effective protection" for LGBT people, and that internal relocation within the country is not a viable protection.
🌐 Transnational repression
Uzbek SGB (State Security Service) actively uses extradition treaties (especially with Russia and Kazakhstan) and Interpol Red Notices. Karakalpak activists living in Russia and Kazakhstan face detention and extradition requests.

UK Home Office CPIN — what is explicitly recognised

📋 CPIN Sexual orientation and gender identity, Uzbekistan — 24 July 2024
This is a critically important document for LGBT cases from Uzbekistan. Direct quotes from the CPIN text:
  • "Overall the state may, but is not willing to provide effective protection to a person identifying as LGBTI."
  • "Because homophobic attitudes are widespread, it is unlikely that there is a place in Uzbekistan to which an LGBTI person could relocate without a fundamental change in their behaviour."
  • "If the claim is refused it is unlikely to be certifiable as 'clearly unfounded' under section 94 of the Nationality, Immigration and Asylum Act 2002."
Caseworker guidance confirms that gay men, bisexual men and trans women from Uzbekistan face likely persecution from state and non-state actors. Lesbians and bisexual women — case-by-case (risk of state persecution is lower but not absent).
Grandfather rule on Hizb ut-Tahrir: in January 2024 the UK House of Commons confirmed the designation of HT as a terrorist organisation in the UK. This creates a legal tension: Uzbekistan persecutes for "HT membership", the UK also bans it. A regulated adviser is needed to draw the line between political persecution on HT charges and actual terrorist activity.

Typical asylum case profiles from Uzbekistan

Description of common patterns under which asylum cases from Uzbekistan have been successfully lodged. This is not a checklist or advice on what applies to a specific person.

🕌 Religious dissidents
Muslims accused of membership or sympathy with Hizb ut-Tahrir, Tablighi Jamaat, Salafi circles. Christian converts and Jehovah's Witnesses. Documentation from Forum 18, OMCT, Human Rights Watch.
🇰🇿 Karakalpak activists
Witnesses and participants of the 2022 protests, especially those who published materials in support of Tajimuratov. After 22 February 2024 any association with "Alga Karakalpakstan" is grounds for a criminal case in Uzbekistan.
🏳️‍🌈 LGBT individuals
CPIN July 2024 directly supports the success of such cases: the state does not protect, internal relocation is not applicable, refusals are rarely certified as clearly unfounded.
🌐 Victims of transnational repression
Civil society activists and journalists continuing political activity abroad. Risk profile is demonstrated through documentation of extradition attempts from third countries and Interpol requests.

Typical evidence

📑 SGB / MVD documents
Summonses (vyzov), decisions, search protocols from the State Security Service (SGB, formerly SNB) or the Ministry of Internal Affairs (MVD). Attention: documents from the CIS region require expert verification — the Home Office Document Fraud team scrutinises them thoroughly.
🌐 Digital evidence
Since Article 244 is often applied for digital distribution — Telegram stories, YouTube uploads, Facebook posts with political or religious content are critically important as evidence of resistance to the regime.
🏥 Medico-Legal Reports (MLR)
For victims of custodial violence — Istanbul Protocol 2022-compliant reports from Helen Bamber Foundation or Freedom from Torture. Documentation of torture patterns in regional SIZOs or the (formally repurposed) Jaslyk prison.
🛐 Sur place activity in the UK
Documented participation in protests at the Uzbek embassy in London, continued online activity from the UK. Counter-argument against "self-serving" — sustained engagement and corroboration from recognised diaspora structures.

Common challenges in Uzbek cases

  • Internal relocation argument: The Home Office may argue the applicant could safely live in Tashkent. Counter — the propiska system strictly regulates the right to work, healthcare and housing; relocation without permission from the authorities is often unduly harsh.
  • "Self-serving" objection to sur place: Standard Home Office argument. Overcome by demonstrating sustained genuine engagement and risk based on actual SGB monitoring of the diaspora.
  • Devaseelan on repeat claims: A large proportion of Uzbek refusals are from the Karimov era (pre-2016). When submitting Further Submissions you need to show how exactly the risk to the personal profile has changed (or persisted) under Mirziyoyev. A general improvement in the country situation does not mean the specific risk has disappeared.
  • Forged documents: The Home Office Document Fraud Team thoroughly checks documents from the CIS region. Forged summonses or court decisions guarantee refusal and permanently damaged credibility.

According to UK Census 2021 — about 3,789 people born in Uzbekistan living in England, predominantly in London, Manchester, Birmingham. Community structures can provide corroboration of sur place activity.
